Terms and Conditions
1.Introduction
Welcome to U.S. Gutter Products, LLC ("Company", "we", "our", "us"). These Terms and Conditions ("Terms", "Agreement") govern your use of our website, products, and services. By accessing our website and purchasing our products, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
2. Definitions
• Customer: Any person or entity who purchases goods or services from the Company.
• Products: Custom gutter supplies and related products offered by the Company.
• Services: Design, manufacturing, and delivery of custom gutter supplies/materials.
3. Orders and Acceptance
3.1. Order Placement: Orders can be placed via email. All orders are subject to acceptance by the Company.
3.2. Order Confirmation: Upon receipt of an order request, we will send an Estimate via email. This email does not constitute acceptance of the order but acknowledges receipt.
3.3. Acceptance: An order is deemed accepted when company receives an email from the customer stating that the order has been approved. Company will acknowledge receipt of acceptance.
4. Pricing and Payment
4.1. Prices: All prices are listed in USD and are subject to change without notice. The price applicable to an order is the price at the time of order confirmation.
4.2. Payment Terms: A 50% deposit must be made on all standard materials before the order is processed. We accept various payment methods, including cash, checks, credit cards, Zelle, and bank transfers. ** All credit/debit card transactions are subject to a 4% processing fee **
4.3. Prepayment for Custom Materials: All custom orders and special order materials require payment in full before manufacturing begins.
4.4. All orders must be paid in full prior to pickup, delivery or shipping.
5. Customization and Specifications
5.1. Customization: We offer customizable gutter supplies based on the specifications provided by the Customer. It is the Customer’s responsibility to ensure that all specifications and measurements provided are accurate.
5.2. Approval: Customers must approve the estimate and confirm specifications in writing before manufacturing begins. Once approved, changes or modifications may incur additional costs and delays.
5.3. Availability: Processing time for custom orders and special order material will vary based on material availability and manufacturing time. We will do our best to give an estimated completion window for custom orders/material but are not responsible for delays due to unforeseen circumstances.
6. Shipping and Delivery
6.1. Shipping: We ship our products to various locations. Shipping costs and delivery times will vary based on the destination and shipping method selected.
6.2. Delivery Time: Estimated delivery times are provided at the time of order confirmation. We strive to meet these estimates but are not responsible for delays due to unforeseen circumstances.
6.3. Risk of Loss: Risk of loss or damage to products passes to the Customer upon delivery to the carrier.
7. Returns and Cancellations
7.1. Returns of Standard Materials: Standard, non-damaged, unused materials may be returned within 10 days of delivery, subject to a 30% restocking fee. The Customer is responsible for return shipping costs.
7.2. Returns of Custom Materials: Due to the custom nature of our products, returns are not accepted for custom materials unless the product is defective or not as specified in the order confirmation.
7.3. Cancellations: Orders may be canceled before manufacturing begins. Once production has started, cancellations may incur charges for materials and labor.
8. Warranties and Liability
8.1. Warranty: We warrant that our products will be free from defects in materials and workmanship upon delivery. This warranty is limited to the repair or replacement of defective products.
8.2. Exclusions: This warranty does not cover damage caused by improper installation, misuse, neglect, or natural wear and tear.
8.3. Liability: Our liability is limited to the purchase price of the product. We are not liable for any indirect, incidental, or consequential damages.
9. Intellectual Property
All content, designs, and materials on our website and produced by the Company are the intellectual property of the Company. Unauthorized use is prohibited.
10. Privacy Policy: Our Privacy Policy, which outlines how we handle your personal information, is incorporated into these Terms by reference.
11. Governing Law: These Terms are governed by and construed in accordance with the laws of the state in which our company is headquartered, without regard to its conflict of law principles.
12. Dispute Resolution
Any disputes arising out of or relating to these Terms or the purchase of our products will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately. Continued use of our services after changes constitutes acceptance of the revised Terms.
